Developing the professional competence of a future lawyer

future lawyerIn this article describes the developing education in the process of the formation of a professional competence of a future lawyer. Proved that developing education in the professional training of future lawyers play an important role, since its implementation cannot simply learn and comprehend the material, but also to analyze, organize, select basic and make conclusions, to be able to adhere own positions.

Today, higher education is in the process of reform, gaining the features of the European, introducing in its practices with international standards, solving various problems of methodological and scientificmethodical aspects of the educational process.

Therefore, the main task of modern higher juridical education is to develop morally sustainable, spiritually rich, enthusiastic and fully developed personality which was the impetus for the gradual eradication of traditional teaching by developmental one, which purpose – to direct methods and techniques for achievement of the maximum efficient development of cognitive capabilities of students: perception, logical, critical and creative thinking, speech, memory, imagination and so on.

Developing education is carried out as a purposeful learning activity in which the student deliberately sets goals and objectives to change himself and to achieve them creatively [1, p. 21].

The first ideas of developing education were formed by ancient Greek philosophers. Currently, there is a need to solve the problem of constructing a complete model of high school development, which provides scientific research and generalization of the experience of the practice of realization of developmental education in the educational process of the university.

In our time the juridical profession is considered to be one of the most prestigious professions, since the need for highly skilled professionals specialty is caused by political, economic, social, cultural, and educational challenges of our time. According to the educational and professional characteristic of training law Bachelor professional juridical knowledge is forming from the comprehensive and profound knowledge of law, its basic principles and tendency of the development, understanding its realization process, confidence in the necessity of a comprehensive accumulation of this knowledge in the process of its activities, skillful ability to use the full arsenal of juridical means of any legal proceedings.

Every lawyer should have an appropriate level of political, ethical and psychological culture: clearly formed the fundamental principles of world outlook as a common understanding about the world and his/her place in it. A path of realization in reality of its vital programs; formed philosophical, economic, political thinking; understand the problems of a market economy, social, national, historical and demographic processes of social development.

Known issues of development of the ancient and new, the modern history of the universe and the Ukraine, to learn the patterns and peculiarities of cultural development of mankind; participate in public life, forming legal consciousness and the civilized relationship of all members of society [2, p. 9].

Ensuring execution of the requirement foresighted with educational and skill standards can only be achieved by properly organized learning process in higher education, where the formation of future professional lawyer originates. That’s why it was decided to implement in practical training model of developing education of future lawyers that makes classes more interesting, dynamic, stimulating revitalization of each student, encourages them to seek new solutions, arguments and defend their own opinions. The term “developing education” in modern didactics was decided to interpret as purposeful consistent interaction of teacher and student designed to build knowledge, skills, intellection, emotions, motives, where students and teachers act as subjects of study [1, p. 21].

Developing education plays an important role in the incipience of future professional lawyer, because it has a number of important tasks, which developed and generalized by modern didacts Pometun A. and G. Freiman. Correlating them with the requirements of government standards to prepare lawyers in the modern university can definitely hold their interpretation to the needs of juridical education.

Thus, developing education in the professional training of future lawyers should assist in:

development of logical, creative and critical thinking, cognitive capabilities, necessary professional competencies; forming their own position to the past, modern and future of Ukraine, skills to implement historical-comparative and juridicalcomparative analysis, historical- juridical criticism, and reconstruction of historical events, phenomena, processes, historical prediction and interpretation of facts that influenced the formation of country and law; using of principles of historical approach at interpretation of different events of political, state lifetime past and present;

ability to give specific comparative analysis to State and Legal structures of different countries of the world, in particular, parliamentary principles of the election system, function of lawenforcement authorities, assert domestic legal and national values; conduct searches of historical documents and ability to explain them;

applying the knowledge about the state-legal ideas of previous years at turning out of modern domestic and foreign legal theories, concepts, ideas;

using Constitution as the main normative – legal act at turning out and interpretation of other laws subordinated normative-legal acts, using international legal sources of Rights for applying at solving legal cases, assessing in the system current legislation and its interpretation.

Approach correct assessment of individual evidence, their totality within legal case and within specific procedural and forensic situations; applying main methods of detection, fixation and investigation of evidence, dealing with mental problems of planning and organization legal process, solving the legal case; making procedural decisions;

elaborating of draft agreements, other legal acts, procedural• documents; analyzing state of keeping legality with areas of legal practice,• criminological description of crime within separate region [2, p. 10];

developing interest of students to special legal and industry subjects as a field of knowledge and how individual subjects, forming students own educational requirements for training and skills to satisfy them;

developing of general culture of students, introducing them to the spiritual and cultural heritage of Ukrainian and other nations, to the historical and cultural traditions of human civilization [3, p. 36].

Proceedings of the International Scientific and Practical Conference 108 To fully achieve the objectives of developing education in preparing future lawyers should not simply give students the knowledge, form skills and develop professional competence over the years of education but should to teach an apply them in practice during future work, therefore the implementing the developing tasks in the educational process will help for each teacher, that is:

operate the basic concepts and terms, which will help by using• crosswords in the educational process; be able to compare, comparison and generalization, which will• help by designing tables during the lessons; find a way out of difficult situations and make the right decisions,• think logically during the investigation, sentencing, etc. which will help by using of situational tasks or problem solving puzzles and riddles, bingo and quizzes;

know how to write a report or statement, to be able to express,• demonstrate and defend own opinion, which will help by using discussions; put oneself other people’s place, give them personal and• psychological characteristics which will help by using the introduction of the business, role, situational or simulation games; be able to work with archival documents, which will contribute• by bringing in the educational process work with historical sources;

avoid errors in the work, known in history of our nation, which• will help by compiling of historical portraits of famous domestic and foreign workers and so on.

Thus, developing education in the professional training of future lawyers play an important role, since its implementation can not simply learn and comprehend the material, but also to analyze, organize, select basic and make conclusions, to be able to adhere own positions. This gives stimulus to the formation of talented, competent, developed personality capable of protecting the rights and interests of others.
